1. Who We Are and Scope
My Challenges: Daily Habits (published in Brazil as "Meus Desafios") is a habit and wellness app developed and operated by Paulo Neves, an individual based in Brazil, who is the controller (the "regulated entity") of your data. This policy explains how we collect, use, share and protect consumer health data as defined by the Washington My Health My Data Act and Nevada Senate Bill 370, and how you can exercise your rights. It applies to consumers in Washington and Nevada and, as a matter of practice, to every user in the United States.
This policy supplements our Privacy Policy, which describes all other personal data we process. My Challenges: Daily Habits is not a health service or a medical device: it does not diagnose, treat or replace advice from a health professional. The app is for people aged 18 or older.
2. Consumer Health Data We Collect
- Water: the amounts of water you log and your daily water goal
- Calories and food: the foods and meals you log, their estimated calories and macronutrients, your calorie goal and, if you use them, food descriptions you type or dictate (dictation is converted to text by your device's system speech service, Apple or Google; only the text reaches us) and food photos (we keep a low-resolution thumbnail of each photo with its estimate; the full-resolution image is not stored)
- Exercise: the workouts you log (activity type, date and duration) and your exercise goal. If you allow it, workout sessions (activity type, time and duration) are read on your device from Apple Health (iOS) or Health Connect (Android) and imported into your exercise log. We only read workouts; we never write to Apple Health or Health Connect
- Sleep: the bedtime, wake time and sleep duration you log and your sleep goal
- Weight: the weights you log over time and your target weight
- Body profile: sex, height, weight, target weight, birth date (used for age), activity level, goal, pace, workout frequency and usual sleep, which we use to calculate your goals
- Progress derived from the above: daily stats, goals met, points, streaks and medals
We do not collect precise location, biometric data, genetic data or data about reproductive or sexual health, and we do not use geofencing.
3. Sources
- Directly from you, when you log a challenge, enter your body profile, describe or photograph a food, or scan a barcode
- From your device, when you allow the import of workouts from Apple Health or Health Connect
- Generated by us, when the app calculates your goals, points and progress, or when our AI provider returns a calorie estimate for a food you described or photographed
4. How We Use It
We collect and use consumer health data only with your consent, given on the app's consent screen, and only to provide the features you request:
- Recording and showing your logs, history and charts
- Calculating your goals, points, streaks, medals and rankings
- Estimating calories and macronutrients from food descriptions and photos (only with your separate, optional AI consent)
- Sending the reminders you turned on
- Keeping the service secure, fixing errors and complying with the law
We do not use consumer health data for advertising, and we do not use it to make decisions that produce legal or similarly significant effects about you.
6. No Sale, No Advertising
We do not sell consumer health data and we do not share it for targeted advertising. We do not collect advertising identifiers.
7. Your Rights
Under Washington and Nevada law, and as a matter of practice for every US user, you have the right to:
- Confirm and access: confirm whether we collect, share or sell your consumer health data, access it, and get the list of all third parties and affiliates with which we share it, with their contact information
- Delete: have your consumer health data deleted, including from our processors
- Withdraw consent: withdraw your consent to the collection and sharing of consumer health data at any time
- Not be discriminated against for exercising these rights
- Appeal our decision on a request (section 8)
8. How to Exercise Your Rights
- Delete: in the app, go to Profile → Settings → Delete account. This deletes your account and all its data, including consumer health data, immediately
- Withdraw consent: in the app, go to Profile → Settings. Withdrawing the required health consent stops the processing of your health data and blocks access to the app until you consent again; your existing data is not deleted automatically, and you can delete your account at any time. Withdrawing the optional AI consent stops sending anything to OpenAI and turns off photo analysis; text and voice food search keep working using only our own food table
- Access, deletion or any other request: email contato@meusdesafios.com.br. To verify your identity, we may ask you to send the request from the email address of your account
We respond free of charge within 45 days, extendable once by another 45 days when reasonably necessary, in which case we will tell you why. If we deny your request, you can appeal by replying to our answer with the word "Appeal"; we will answer the appeal in writing within 45 days. If the appeal is denied, you can contact the Washington State Attorney General (atg.wa.gov) or the Nevada Attorney General (ag.nv.gov).
9. Retention
We keep consumer health data while your account exists and delete it when the account is deleted. Accounts frozen because the user is under 18 keep their data until the 18th birthday or until the account is deleted, whichever comes first. Records of your consents may be kept as long as needed to prove compliance. See the Privacy Policy for details.
10. Changes
We may update this policy. The date of the last update is shown at the top of this page. If a change affects your consent, we will ask for it again in the app before the change applies.
